 The documents I should recieve prior to the First Meeting of Creditors are listed below and, wherever possible SHOULD NOT BE SCREENSHOTS.  These requests are supported by the 2012 update to the Trustee's Handbook available on the DOJ website.  I am attaching some relevant and highlighted pages here.Excerpts from Handbook for Chapter 7 Trustees.pdf

My 341 exams are held on Fridays and I am transitioning to Zoom from the previously used Telephone Appearaqnces. For this reasn it is critical I have a valid email address to send the Zoom call in link in advance of the meeting.  I will also use the email to communicate other questions in advance that may be better resolved before the interview under oath.  

  1. All 521 documents must be submitted no later than 7 days prior to the hearing dateUST best_practices.pdf For Debtor Attorneys an upload of documents through Bluestylus.com is appreciated. Providing documents 7 working days before the Friday meeting of creditors is greatly appreciated. These include both Federal and State tax returns for the most recently filed year, 60 days of pay advices, 60 days of banking or debit card activity for the period immediately prior to filing.
  2. Prepaid Debit cards are to be treated as bank accounts and documentation for them provided as you would all listed bank accounts on Schedule B.
  3. Petition must also list as dba or fdba any business operated by the debtor in the last 5 years. The same information should be listed in SOFA question 18.
  4. Petition must use the names listed on the identification documents provided. Photo ID and Proof of Social Security Number are the most typical documents used. The US Trustee has posted a list of acceptable documents.Proof of Identity.pdf 
  5. If Debtor is married and filing alone due to separation please indicate SEPARATED on Schedule I under the spouses employer. If filling alone and NOT SEPARATED  file the Spousal Waiver if using 703 exemptions.spousal waiver.pdf
  6. Employer address must be on Schedule I. If the debtor is married and filing without their spouse the spouse’s employer is to be listed here as well with income information. If the non-filing spouse operates a business, see and comply with item 7.
  7. Any business operated by the debtor/or non-filing spouse will require additional 521 documents. To comply with Item 6 above you will need to supply business bank accounts, a balance sheet and Profit and Loss for the last 12 months and last quarter of business operation. NOTE: Call me if your client is still operating a sole proprietor business.
  8. Mortgage statements supporting the Schedule D encumbrances must be included in the 521 documents for all real property. Unencumbered vacant lot property should have a tax bill with APN provided.
  9. Divorced debtors must supply a Marital Settlement Agreement with their 521 documents if the divorce has occurred within the last 5 years.
  10. I require copies of Trust documents if any are noted on Schedule B, the Mortgage or banking statements.
  11. Do not use the Schedule C box “100% FMV”. I will not conclude a 341 hearing until this is amended to use appropriate California exemptions.
  12. For Debtors and Creditors without an attorney - I must have a Debtor's email to share some of the pre-meeting documents and they must send me proof of identification before the 341 exam.  Please contact my office if you are a person without counsel.  If a Debtor has counsel then Counsel should be managing this process and explaining the ground rules for appearing at the 341 exam.
