As Chapter 7 trustee, David Leibowitz adheres to "Best Practices for Document Production" as they may be amended from time to time. These Best Practices will soon be a part of the Chapter 7 Trustee's handbook. The US Trustee will expect Chapter 7 trustees to adhere to the Best Practices. Members of the Debtor's Bar should not notice any significant changes in the manner that Mr. Leibowitz handles documents requests in their cases.

Mr. Leibowitz always requests at a minimum the documents required by Federal Rule of Bankruptcy Procedure 4002(b). In most cases, Mr. Leibowitz will request at bank statements for a period of at least 3 months prior to the commencement of the case to evaluate possible preferences and to evaluate income and expenditures relative to income and expenditures as set out in the Debtor's Schedules I and J and Statement of Financial Affairs.

Where appropriate, Mr. Leibowitz will request copies of automobile titles, statements from creditors with secured debts, documents related to insurance policies or retirement funds claimed to be exempt. Mr. Leibowitz makes every effort to tailor his discovery requests to the needs of the particular case. Where there is any question, he will not hesitate to seek the Court's assistance in this respect utilizing Federal Rule of Bankruptcy Procedure 2004. In most instances, document requests and production have been addressed by the Debtor's Bar efficiently and without controvesry. For this, the Trustee expresses his appreciation to the Debtor's Bar
